The estate information for John Posey d. 1803 in Spartanburg Co., SC is

Page 8. In the Court of Ordinary 27th Aug 1803. The non-cuperative will of John Posey late dec'd was presented by [sons] Richard Posey & William Posey. The widow Ann Posey being present and being asked did not object.
In the Court of ordinary 3rd Sep 1803. Qualified Richard Posey and William Posey executors of John Poseys will. Gave them a copy of said Poseys non-cuperative will. Issued a warrant of appraisement to Jesse Spencer, Josiah Hatchett, Martin Outs, Robert Foster to appraise said estate.
Page 9. The Last Will and Testament of John Posey late of Spartanburg District - planter deceased declared by him by word of mouth 11 July 1803 my whole estate to be sold and divided between my wife and two children except a colt to my sister in law Polley Moore. 27 Aug 1803. Wit. Richard Posey, Ann Moore, Ann Posey
Pages 85-86. LWT of Samuel Otts. Rec'd 19 Apr 1816. Wife to keep and raise children . CODICIL:Wife Sarah and John Otts appoints William Otts and executor. Witness Nancy Posey, Andrew Moore.

Note - If Ann Posey was the stated widow, clearly John Posey's wife was NOT named Nancy. Nor is there any evidence to indicate John was ever identified as Jr.

There are 3 Poseys listed in the Aug 1800 census for Spartanburg Co., SC, with this John shown as
John Posey 0 - 0 - 1 - 2 - 1 Self over 45, 2 son 25/45, male <25
Females 0 - 0 - 0 - 0 - 1 Wife over 45.
6 lines away is Broderick Mason, 30 lines before is Thomas Posey, 8 lines further is Thomas Posey's probable bro John Posey (not shown as 'Jr.'). If sons/executors William and Richard Posey were living with John, it explains why they are not in the 1800 census. Broderick Mason m. Thomas Posey's sister Jane. For some reason Thomas Posey's bro Zephaniah is not separately listed until the 1820/30/40 census.

John Posey's widow 'Ann' can clearly be identified as Ann Ford, b. cir 1740 in Prince William Co., VA to Thomas Ford Esq (abt 1704 - bef 16 Dec 1776) and Jane Milstead (abt 1705 - aft 16 Dec 1776). One of Ann Ford's brothers was named John Ford Sr., who had several sons including William, Jesse and Elisha Ford. The Ford family - who moved to Shelby Co., KY from Spartanburg Co., SC around 1800 - are clearly identifiable in the following documents as is John Posey and Thomas Posey on adj properties in 1787 :

John Ford" P/A [Power of Attorney] to son Jesse, to sell tract on Tyger River adjoining John Posey, Richard Barry, also 420 acres, granted James Miller, adj John Posey on west and Richard Barry on East.
Spartanburg Co., SC Deed Abstracts Books G-H, Pages 7-9, 22 Jul 1801.
Thomas Posey, 217 acres in 96 District, on branch of Fair Forrest Creek in Spartansburgh Co., SC (actual plat shows John Posey adj on south) Warr 8/16/1786, surv 8/17/1786. State Book 8-444, 3/19/1787.

NOTE: While John Posey d. in 1803, his will was not finalized (i.e. title transferred) until after 1806 so the land was still identifed as his in 1806.
Vol. I, Pg. 311: Book K, "p. 252-253 Nov. 9, 1805 William Wells (Spartanburgh) to Jesse Wells (same); for $155 sold 100 ac on both sides Ford's Cr; border: John POSEY, John Bouling, Thomas Price, William Tinsley, Brodrick Mayson, Henry Wells, and Benjamin Peper; part of tract sold by Henry Wells to Travis Reese. Witness Andrew B Moore, John Otts, and Jehu Wells. Signed Wm Wells. Wit. oath Feb. 3, 1806 Jehu Wells to Abner Benson. Rec. Feb. 3, 1806."

Elisha Ford and wife Sarah (of Newberry Co.) to John Posey (of Spartanburg Co.) for 50 pounds sterling sold 250 acres, part of 400 acre grant to Elisha Ford from Gov. William Moultrie. Witness Charles Moore, William Ford, Robert Gudgeon.
Signed Elisha Ford, Sarah Ford.
NOTE - Elisha sold 187 acres to Robert Goodgeon the same day, John Posey witness. Charles Moore may be John Posey's bro-in-law, as he notes a sis-in-law Polly Moore.

Two other Poseys in the 1800 (and later) Spartanburg Co., SC can be identified as Thomas and Zephaniah Posey, sons of Humphrey Posey of Patrick and Henry Co., VA. Documentation of that relationship is in some of my prior postings. I have also tentaively assigned the other John Posey in the 1800 census (who m. Susannah Trail) as Thomas and Zephaniah's older brother.

Clearly there was a close family relationship between John Posey d. 1803 in Spartanburg SC, and Humphrey Posey who remained in Henry Co., VA but who had 3 sons as well as a dau (Jane Posey who m. Broderick Mason and had sons named Ford Mason and Posey Mason) who moved to Spartanburg Co., SC. It is therefore reasonable to tentatively identify John Posey and Humphrey Posey as brothers. Since both also have documented Prince William Co., VA (or at least Henry Co./Patrick Co., VA) origins, their most probable father is Benjamin Posey of Prince William Co., son of Humphrey who d. bef 24 May 1718.

This also suggests two additional brothers for John Posey d. 1803 in Spartanburg Co., SC, since Joy McDaniel as well as myself currently also identify Francis 'Farr' Posey d. bef 19 Dec 1787 in Orangeburg District SC (not far from Spartanburg) and Nehemiah Posey (who had land in Orangeburg District but d. bef 25 Sep 1819 in Pulaski Co., GA) as sons of Benjamin Posey of Prince William Co., VA.

While there is no proof of all these links, it will prove difficult - short of DNA evidence - to propose a better interpretation of the above evidence.
