INDENTURE BETWEEN WILLIAM THURSTON
AND JOHN THURSTON OF GOOCHLAND COUNTY, VIRGINIA

“This Indenture Made this Twelth Day of January in the year of our Lord One Thousand seven Hundred and seventy one Between William Thurston of The county of Goochland of The one part, and John Thurston of the said County of the other part - Witnesseth, That the said William Thurston, for and In consideration of the Sum of Twenty pounds of Lawfull Money of Virginia By him the said John Thurston to him the said William Thurston in Hand before the Sealing and Delivery Hereof The Receipt Whereof he the said William Thurston Doth Hereby Acknowledge, and Thereof Doth Acquit and Discharge the Said John Thurston His Heirs, Executors, and Administrators, Hath Granted, Bargained, Sold, Engrossed, and Confirmed, and by These Presents Doth Grant, Bargain, Sell, Engross, and Confirm Unto The said John Thurston his heirs and assigns, One Certain Tract or parcel of Land Containing By Estimation One hundred Acres, be the same More or less lying and Being in Goochland county, On a Branch of Beech Creek And Being Bounded as Followeth (To Wit) Begining in a Branch at a Corner pine and popplar, thence on The Line of Josias Payne and James George, Eighty poles, to a Corner pine on Jervas Elam, thence, North One hundred and Fourteen poles to a corner white oak, on Paynes road, Thence, up the road according to its meanders One Hundred and ten poles To a Corner pine, Thence South Sixty Eight Degrees, West Eighty Four poles, to a Corner on William Davis’s Line, Thence a New Line on William Thurston to the place Began at. Which said Tract or parcel of Land, is part of a Tract of Land purchast By the said William Thurston, of James George, as may appear by the Office of the County Court of Goochland, and the Reversion and Reversions, Remainder and Remainders, Rents, Dues (?), and Profits thereof with the Appurtenances, To Have And to Hold the said Messuage, plantation and Tract of Land, With the Appurtenances Unto the said John Thurston his heirs, and assigns, to The Only Use and Behooff of the said John Thurston his heirs and assigns for Ever, and the said William Thurston his Heirs & The Said Messuage Plantation and Tract of Land, With the Appurtenances, untohim The said John Thurston his Heirs and Assigns Shall and will Warrant and forever Defend By these presents Against the Claim, and Demand of him the said William Thurston his Heirs and Assigns or any other person whatsoever, and the said William Thurston for himself his Heirs, Executors and Administrators Doth Covenant promise and agree to and with the said John Thurston his Heirs and Assigns That the premises, and any part thereof, With the Appurtenances, are Free, and Discharged from all Manner of Incumbrances and that the said John Thurston his Heirs & for and not withstanding any Act or thing By him the said William Thurston his heirs, or assigns Or any person commited done Or Suffered, shall or Lawfully May for Ever Hereafter Have Hold Use Occupy Possess and Enjoy the same and Every part thereof with the appurtenances Without the Lawfull Lett Molestation Or Eviction of him the said William Thurston, his heirs or assigns or any other person Whatsoever. In Witness Whereof I have Hereunto Set my Hand, and Affixed my seal the day and year above Written.
